Expelled Romani to sue state

The 23 Romani who were deported to Romania for setting up illegal camps are reportedly ready to sue the Danish state over the matter, reports Information newspaper.

Robert Kushen, head of the European Roma Rights Centre, told Information that his organisation was behind the lawsuit on the grounds that ‘the expulsions were contrary to both Danish and EU law’.

Several of the country’s leading legal experts have told Information that the Romani have a good case. They stated that the Romanians are EU citizens who are guaranteed free movement between member states, and that a violation such as illegal camping is not normally sufficient grounds for expulsion.

Police asserted prior to the arrests, however, that some of the Romani squatters had been stealing items from nearby homes.

According to the EU’s residency rules, legal EU residents can only be deported if their behaviour is tantamount to ‘a real, immediate and sufficiently serious threat to a society’s basic interests’.
